These terms govern your use of the carpathianclassic.ro website and your entry in the Carpathian Classic regularity rally. By using the site or submitting an entry you accept them. The sporting side of the event — eligibility, timing, penalties, prizes — is governed by the Supplementary Regulations of each edition; where the two differ on a sporting matter, the Regulations prevail.
1. Who we are
The site and the rally are operated by ACS Klausen Retro Legends (the "Organiser"), a sports club registered in Romania under CUI 50815060, with its seat at Str. Livezii 63, Cluj-Napoca. Contact: [email protected].
2. Using the website
The site presents the current edition, its programme, route and regulations, the entry form, the public entry list and results, and an archive of past editions. All content — texts, photographs, videos, route maps, logos and the Carpathian Classic name — belongs to the Organiser or its partners and is protected by copyright and trademark law. You may view and share links to it; you may not copy, alter or reuse it commercially without written permission.
You must not use the site to send abusive, false or unlawful content, to submit entries on behalf of people who have not authorised you, or to interfere with its operation. We may suspend access to anyone who does. The site is offered as is: we work to keep it accurate and available, but we do not guarantee uninterrupted access, and information about an edition may change until its Regulations are published.
3. Who can enter
An entry is made by a crew of two: a driver and a co-driver. Both must be at least 18 years old on the first day of the edition and hold a valid driving licence appropriate to the car, which may be driven during the event only by the two registered crew members. The car must belong to one of the categories published for that edition, be roadworthy, registered and insured as required by law, and pass the checks described in the Regulations. The Organiser may refuse or cancel an entry that does not meet these conditions, or that exceeds the edition's capacity, in which case any fee paid is returned.
4. How an entry is made
- You complete the online entry form for the current edition, including the seven declarations it contains. Everything you enter must be accurate and up to date; you are responsible for the information you give about yourself, your co-driver and your car.
- The Organiser reviews the entry. If it is accepted, you receive an email with the entry fee due and the bank details for payment. If the edition is full, the entry is placed on the waiting list in the order received and you are told when a place frees up.
- You pay the entry fee by bank transfer within the period stated in the acceptance email, quoting the driver's and co-driver's full names in the payment details.
- Once the payment has arrived, the Organiser confirms the entry by email. Only a confirmed entry holds a place at the start. The public entry list shows confirmed crews.
The contract for participation is concluded when the Organiser confirms your entry. Until then, the Organiser is free to decline it and you are free to withdraw it without cost.
5. Fees and payment
The entry fee for each edition, what it includes, the early-bird rate and its deadline, and the fee for additional passengers are published in that edition's Regulations and on the entry page. Fees are payable in RON or EUR exclusively by bank transfer to the Organiser's account at Banca Transilvania; the site does not take online payments. The fee is non-transferable to another crew.
6. Withdrawal, refunds and cancellation
Refunds follow the Regulations of the edition you entered:
- an amount paid under the early-bird rate is not refundable if the crew withdraws;
- a crew that has paid the full entry fee and cannot take the start because of force majeure receives a refund of 50 % of the fee, provided it notifies the Organiser no later than the date set in that edition's Regulations;
- in any other case of withdrawal the fee is not refunded.
If the Organiser has to cancel, shorten or postpone an edition — for example because of weather, an authority's decision or another event outside its control — it will inform the confirmed crews without delay and apply the Regulations of that edition and the applicable law to the fees paid.
Consumer note. Participation in the rally is a leisure service to be provided on a specific date. Under art. 16 (l) of Romanian Government Emergency Ordinance 34/2014 (implementing Directive 2011/83/EU), the 14-day right of withdrawal for distance contracts does not apply to it. The refund rules above are therefore the ones that govern.
7. Conduct, safety and liability
The rally takes place on public roads, in normal traffic, under the road traffic rules in force. Crews drive at their own risk and are responsible for their own conduct, for their car and for any damage they cause to third parties, the Organiser or other participants. A road-traffic offence recorded by the police or by the officials leads to exclusion from the event without refund, as does a breach of the Regulations or of the officials' instructions. The declarations accepted in the entry form — accurate information, compliance with traffic law, valid insurance, acceptance of risk, acceptance of the Regulations and personal responsibility — form part of these terms.
The Organiser is liable for damage caused by its own fault, as provided by law. To the extent permitted by law it is not liable for accidents, damage, loss or injury arising from participation, from the actions of other participants or third parties, from the condition of the roads, or from events beyond its control.
8. Photos, video and publicity
Photographs and video are taken throughout the event. By entering you acknowledge that images and recordings of you, your crew and your car, together with the driver's and co-driver's names and the car's details, may be published on this website, on the rally's social-media channels and in press and promotional material for the Carpathian Classic, without payment. If you do not want to appear in such material, write to [email protected] and we will take reasonable steps to comply — see the Privacy Policy. The Regulations set out the sponsor advertising crews must carry on their cars.
9. Personal data
How we collect and use personal data through the site and the entry process is described in our Privacy Policy; cookies are covered by the Cookie Policy.
10. Complaints, applicable law and disputes
Questions or complaints about the site or your entry can be sent to [email protected]; we answer within 30 days. Sporting protests and appeals follow the procedure in the Regulations. Consumers may also contact the Romanian National Authority for Consumer Protection (ANPC, anpc.ro) or use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr. These terms are governed by Romanian law. Disputes that cannot be settled amicably are brought before the competent courts of Cluj-Napoca, without prejudice to the mandatory rights consumers have under the law of their country of residence.
11. Changes
We may update these terms when the site or the event changes. The version in force is the one published here on the day you submit your entry; the date of the last update is shown at the top of the page. If any provision is found invalid, the rest remains in effect.
